Race Discrimination

Our Individual and Case Support service provides confidential advice, guidance, and advocacy to help individuals facing discrimination, inequality, or injustice navigate their challenges and access the support they need.

What is Race Discrimination?

Race discrimination happens when someone is treated unfairly or differently because of their race, i.e.ethnicity, nationality, skin colour or national origin. This kind of treatment is illegal under the Equality Act 2010, which aims to prohibit discrimination and promote equality of opportunity for all individuals.
An example of race discrimination is when an employer refuses to hire someone because of their ethnicity, even if they are fully qualified for the role. This unfair treatment is a form of direct discrimination and is prohibited by law.

Understanding Race Discrimination

Race discrimination can take various forms, all of which are unlawful under the Equality Act 2010. It can affect individuals in the workplace, education, or when accessing services. Below are the different types of race discrimination to be aware of:

Direct Discrimination

This occurs when someone is treated less favourably because of their race, ethnicity, nationality, or skin colour. For example, an employer refusing to hire someone purely because of their ethnic background.

Indirect Discrimination

Indirect discrimination happens when a policy or rule applies to everyone but disproportionately impacts people of a particular race. An example might be a workplace policy that unintentionally disadvantages a certain ethnic group due to cultural practices.

Harassment

Harassment involves unwanted behaviour linked to someone’s race that creates a hostile or offensive environment. This could include racist jokes, comments, or other forms of degrading treatment.

Victimisation

Victimisation occurs when someone is treated unfairly because they’ve made a complaint about race discrimination or supported someone else’s complaint. This could involve being demoted or excluded as retaliation for speaking out.

Success Stories & Case Studies

Below is an example of a person we helped recently with a race discrimination case; their name and identifiable information have been omitted to ensure their anonymity.

Supporting a client in His Workplace Discrimination Case

Our client was a qualified engineer. He was overlooked for promotion several times, despite having more experience than his peers. He suspected it was due to his ethnicity, as others with fewer qualifications were promoted instead.

After contacting TREC, we helped him to file a formal complaint with his employer and supported him through the process. With our assistance, the company reviewed their practices, and he was offered the promotion he deserved.

The organisation also committed to improving their internal diversity and equality policies to prevent future discrimination.
